THE EUROPEAN UNION ALLOWED CONFISCATION OF ASSETS AND PROPERTY FOR BYPASSING SANCTIONS AGAINST RUSSIA

 EU countries should make appropriate changes to their legislation.

From now on, EU countries have the right to confiscate funds and property for circumventing established sanctions. And in order to apply such actions to violators, it is necessary to prove that the value of the assets to be seized does not correspond to the income of the owner.


The new rules are established by the directive, which was placed in the legislative framework of the EU and the Council of the EU, reports The Moscow Times.


"When determining whether property should be confiscated, national courts must take into account all relevant circumstances of the case, including available evidence and specific facts, such as the fact that the value of the property is significantly disproportionate to the person's legitimate income," the document says.


The lack of evidence of the legality of the acquisition of property and the person's connection with a criminal organization will also speak in favor of confiscation.


At the same time, proof of certain crimes can be a "precondition for the confiscation of incomprehensible wealth." It must be confirmed that such property or funds were obtained precisely as a result of the crime.


It is noted that confiscation of "unexplained wealth" will be threatened for illegal arms trafficking, fraud and sanctions evasion.


The directive is one of the types of EU legislative documents. However, unlike the resolution, the directive does not have direct effect, and obliges EU countries to make adjustments to their domestic legislation.
